The Law

Excerpt from Code of Virginia § 53.1-131 Any court having jurisdiction for the trial of a person charged with a misdemeanor or traffic offense or charged with any offense under Chapter 5 (§ 20-61 et seq.) of Title 20 may, if the defendant is convicted and sentenced to confinement in jail, impose the time to be served on weekends or nonconsecutive days to permit the convicted defendant to retain gainful employment. A person sentenced pursuant to this section shall pay an amount to defray the cost of his keep. If the defendant willfully fails to report at times specified by the court, the sentence imposed pursuant to this section shall be revoked and a straight jail sentence imposed.

Requirements to Serve a Nonconsecutive/Weekender Sentence

  1. Only the court can excuse you

The defendant will not be excused from serving any sentence as directed by the court unless he/she receives authorization from the sentencing court/jurisdiction prior to reporting to the jail. The jail does not have the authority to excuse anyone.

  2. Other circumstances

Any defendant that does not fit the above criteria will be handled on a case-by-case basis and will require authorization from the sentencing court/jurisdiction.

  3. Personal items

No money, hygiene items, food, tobacco products, extra clothing, magazines or other items will be allowed into the jail, except for proof of I.D. (picture I.D.) and “cost to keep” money, which is $19.00 per day — NO EXCEPTIONS!

  4. Mail and messages

Do not bring or attempt to deliver any messages or mail into the jail, or carry any mail out.

  5. Medications & medical changes

All prescription medications will be turned over to the Medical Department. Inform the Booking Officer if there has been a change in your medical condition.

  6. Alcohol and drugs

Do not consume anything containing alcohol or any illegal drugs. A urinalysis test may be required after your 2nd weekend and any time thereafter. Any degree of positive results will receive an institutional disciplinary action.

  7. Questions about your sentence

All questions concerning your sentence must be directed to the Records Department by calling 434-392-1601 during office hours. Office hours are Monday–Friday from 8:00 AM until 5:00 PM. If at any time while serving your sentence you wish to serve your sentence straight, you must advise the officer and/or supervisor on duty.

  8. Cost of keep & payment

The fee for “cost of keep” is $19.00 per day (24 hours). All monies for nonconsecutive/weekender days served must be paid in advance, two (2) days prior to serving your nonconsecutive/weekender sentence. Your payment must be made in postal money orders only (no exceptions). Payment cannot be made in installments. The full payment must be made prior to the beginning of your sentence. No checks accepted. No fees paid are refundable.

Note: “Cost of keep” is subject to change at any time.

  9. Failure to pay

If the defendant fails to pay for “cost of keep,” the defendant will be required to serve the entire sentence straight, as directed by the court/jurisdiction.

  10. New charges or infractions

If you receive a new/additional arrest charge, your weekend status will be revoked. If you receive an institutional infraction, your weekend status will be revoked (pending the outcome of the hearing), and you will be subject to completing the remainder of your time straight.

  11. Processing fee

There is a one-time processing fee of $10.00 that must be paid prior to reporting to jail.

Paying Your Fees

Postal money orders only. Full payment is due two (2) days before your sentence begins. No checks, no installments, no refunds.
